MEMBERSHIP AND REGISTRATION.
EMSvillage.com and FireRescueVillage.com are member driven web sites. We have two types of memberships. The Standard Membership does not require registration with us and allows anonymous viewing of our content. Standard members must still abide by the "Terms of Use" agreement. An Interactive Membership requires you to register for a login name and password. The interactive membership allows you to post content and otherwise interact with the web site on a higher level then the standard membership. It also allows you to register for our opt-in only newsletters. At registration, we do collect some basic information such as your real first and last name, valid e-mail address, year of birth, sex, country and zip / postal code. As per our Privacy Statement, we will never sell this information to anybody or provide it on an individual level to an outside company without your express permission. You also will not receive any regular e-mails from us unless you sign-up for our opt-in newsletters. From time to time, registered members may receive important email notifications concerning changes to the "Terms of Use" agreement or other important site updates. Failure to provide any required information or intentionally falsifying this information may result in temporary or permanent interactive membership suspension.
USE OF CONTENT.
Sirius Innovations, LLC authorizes you to view or download a single copy of the material from the EMS Village web site solely for your personal, noncommercial use if you include the following copyright notice: "Sirius Innovations, LLC. All rights reserved" and other copyright and proprietary rights notices which were contained in the Content. Any special rules for the use of certain software and other items provided on the EMS Village site may be included elsewhere within the site and are incorporated into these terms and conditions by reference.
The Content is protected by copyright under both United States and foreign laws. Title to the content remains with EMS Village or its licensors. Any use of the content not expressly permitted by these terms and conditions is a breach of these terms and conditions and may violate copyright, trademark, and other laws. Content and features are subject to change or termination without notice in the editorial discretion of Sirius Innovations, LLC. All rights not expressly granted herein are reserved to Sirius Innovations, LLC and its licensors. If you violate any of these terms and conditions, your permission to use the content automatically terminates and you must immediately destroy any copies you have made of any portion of the content.
MESSAGE FORUMS
Considering the real-time nature of this site, it is impossible for us to review messages or confirm the validity of information posted. Please remember that we do not actively monitor the contents of posted messages and are not responsible for any messages posted. We do not vouch for or warrant the accuracy, completeness or usefulness of any message, and are not responsible for the contents of any message.
The messages express the views of the author of the message, not necessarily the views of Sirius Innovations, the EMS Village web site or any entity associated with Sirius Innovations. Any user who feels that a posted message is objectionable is encouraged to contact us immediately by email. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, if we determine that removal is necessary. This is a manual process, however, so please realize that we may not be able to remove or edit particular messages immediately.
You agree, through your use of this service, that you will not use our message forums to post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violate of any law. You agree not to post any copyrighted material unless the copyright is owned by you or Sirius Innovations, LLC.
Although this Sirius Innovations, LLC does not and cannot review the messages posted and is not responsible for the content of any of these messages, we reserve the right to delete any message for any or no reason whatsoever. You remain solely responsible for the content of your messages, and you agree to indemnify and hold harmless Sirius Innovations, LLC, and their agents with respect to any claim based upon transmission of your message(s).
We also reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message posted by you. Please note that advertisements, chain letters, pyramid schemes, and solicitations are inappropriate material for the message forums.
USER SUBMISSIONS.
You agree that you will not upload or transmit any communications or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this Site, you agree that such submission is non-confidential for all purposes. If you make any such submission, you automatically grant--or warrant that the owner of such content has expressly granted-Sirius Innovations, LLC a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form, format or forum now known or hereafter developed. Sirius Innovations, LLC may sublicense its rights through multiple tiers of sublicenses.
CHILDREN'S PRIVACY.
We are committed to protecting the privacy of children. You should be aware that this Site is not intended or designed to attract children under the age of 13. We do not collect personally identifiable information from any person we actually know is a child under the age of 13.
LIABILITY OF Sirius Innovations AND ITS LICENSORS.
The use of the EMS Village Site and the content is at your own risk. When using the EMS Village web site, information will be transmitted over a medium which is beyond the control and jurisdiction of Sirius Innovations, LLC and its suppliers. Accordingly, Sirius Innovations assumes no liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with use of the EMS Village web site.
The EMS Village web site and the content are provided on an "as is" basis. Sirius Innovations, ITS LICENSORS, AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, ADVERTISEMENTS AND LINKS TO OTHER SITES.
Sirius Innovations does not endorse the content on any third party websites and is not responsible for the content of linked third-party sites, sites framed within the EMS Village web site, or third party advertisements, and does not make any representations regarding their content or accuracy. Your use of third-party web sites is at your own risk and subject to the terms and conditions of use for such sites. Sirius Innovations does not endorse any product advertised on the EMS Village web site.
INDEMNITY.
You agree to defend, indemnify and hold Sirius Innovations, its officers, directors, employees, agents, licensors and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
GENERAL.
Sirius Innovations is based in Monroe, Connecticut, in the United States of America. Sirius Innovations, LLC makes no claims that the Content is appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the EMS Village web site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. The following provisions survive the expiration or termination of these Terms and Conditions for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.
JURISDICTION.
You expressly agree that exclusive jurisdiction for any dispute with Sirius Innovations, LLC, or in any way relating to your use of the EMS Village web site, resides in the courts of the State of Connecticut and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Connecticut in connection with any such dispute including any claim involving Sirius Innovations, LLC or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.
These Terms and Conditions are governed by the internal substantive laws of the State of Connecticut, without respect to its conflict of laws principles. If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these terms and conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
COMPLETE AGREEMENT.
Except as expressly provided in a particular "legal notice" on the EMS Village web site, these terms and conditions constitute the entire agreement between you and Sirius Innovations, LLC with respect to the use of the EMS Village web site, and content.
